What happened: On Jan 3, Superior bar representatives threatened to boycott all court hearings against the meeting of Judicial Commission of Pakistan on Jan 6. The meeting will be held to discuss Justice Ayesha Malik’s nomination for Supreme Court Judge. Details: The representatives in the meeting took note of Justice Ayesha Malik’s nomination in the Honourable Supreme Court, which they believe, violated the principle of seniority by overlooking three Honourable judges of the Lahore High Court. According to them, they are not only senior in service, but also senior in legal practice. The participants also agreed that the bar is leveling down the criteria for appointing judges for the superior judiciary in the High Courts and the Federal Shariat Court as well. Therefore, they ended up requesting the CJP to reconsider his appointment of Justice Ayesha Malik as the Supreme Court Judge, Pakistan, or else they’ll have to boycott all the court proceedings as a protest against the scheduled meeting. What you need to know: In March 2012, Justice Ayesha was appointed to the LHC as a judge, and she is now ranked fourth on the LHC judge seniority list. In case she gets elevated, Ayesha Malik will then be able serve as a Supreme Court judge until June 2031 and after Justice Yahya Afridi retires in January 2030, she will be able to take over as Chief Justice of Pakistan. It is pertinent to know that in the history of the country’s judicial history, no female judge has ever been elevated to the Supreme Court.
