Forced child marriage could also be a case of ‘strict liability rape’ reveals Jibran Nasir

Details: In a timely Twitter thread, the social activist and lawyer @mjnasir narrated the definiton of child marriage and its uncertainties. Jinram wrote,  “If the girl in question is a minor & she has been subjected to Child Marriage then this may potentially also be a case of strict liability rape (if a girl under 16).”  There were a lot of uncertainties around the law, but Jibran categorically defined it in the thread, as Dua Zehra’s case was in discussion.  Also: At the same time, the lawyer also highlighted,  “If the girl is a minor from Sindh, then her marriage is an offense of Child Marriage. She is a victim of a criminal offense… The police shouldn’t take her Nikah Nama as a defense.”  It is pertinent to mention that on April 25, it was reported that Dua was found in Lahore, but later in an interview, Dua’s father confirmed that she was not found but only a Nikah Nama is being surface on social media.
