Reuters and The Guardian reported, “In the wake of the principle of equality and in the child’s interest, both parents must be able to share the choice of their surname, which constitutes a fundamental element of personal identity.” Details: Subsequently, this new statement by the Italy court would allow both parents to assign their child’s surname in an order they agree upon, and if both the parents decide to go with a single surname to the child, that would also go in accordance with the law. On the other hand, Italy’s Constitutional Courts have further claimed, “Automatically assigning the father’s surname was unconstitutional, and the practice violates numerous articles of the constitution.”
